SmartFleet — Terms of Service

By accessing or using SmartFleet's freight dispatch platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

SmartFleet LLC ("SmartFleet," "we," "us") provides a freight dispatch management platform that connects truck drivers (carriers) with freight brokers (shippers) and facilitates load management, communication, and operational coordination through web, SMS, WhatsApp, and email channels.

• You must provide accurate, current, and complete information when creating an account or being onboarded to the platform.
• You are responsible for maintaining the security of your account credentials.
• You must promptly notify SmartFleet of any unauthorized use of your account.
• You are responsible for all activities that occur under your account.

By consenting to receive SMS messages through our onboarding process, you acknowledge and agree that:

• SmartFleet will send operational, non-marketing messages to your phone number
• Message frequency varies based on load activity
• Message and data rates may apply
• You may opt out at any time by replying STOP to any message
• You may get help by replying HELP to any message

As a driver using SmartFleet, you agree to:

• Maintain valid licensing, insurance, and compliance documentation
• Provide accurate and up-to-date information about your equipment and availability
• Respond to load assignments in a timely manner
• Complete accepted loads according to the agreed terms
• Comply with all applicable federal, state, and local regulations

All content, features, and functionality of the SmartFleet platform — including text, graphics, logos, and software — are the exclusive property of SmartFleet LLC and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

To the maximum extent permitted by law, SmartFleet shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

SmartFleet does not guarantee the availability, accuracy, or completeness of any load information, rate data, or broker information provided through the platform.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may discontinue your use of the Service at any time. Upon termination, your right to use the Service immediately ceases.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles.

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
